General rental conditions

The “Equipment rental” service is provided by LocaBeach Anglet, hereinafter the rental company. The rental conditions are an integral part of the rental contract. By signing, the co-contractor, known as the lessee, confirms having read and fully accepted the rental conditions.

1. Hardware Support

The lessee takes charge of the equipment in good working order. For the use of the equipment, the lessor undertakes to explain the operation of the equipment so that the lessee can use it properly. He is required to make any complaints to the rental company when picking up the equipment. The lessor cannot be held responsible for any subsequent failure, whether material or physical.

2. Return of material

The lessee is required to return the equipment to the lessor at the end of the rental period defined in the rental contract, and this, during opening hours. The equipment made available by the rental company must be returned to the rental company in the same condition as that entrusted to it. If the lessee has lost or damaged accessories, he is required to notify the lessor, they will be invoiced for them. Material damage is billed at the rates published in store.

3. Extension of the rental period

An extension of the rental contract is only possible with the consent of the lessor before the end of the current rental contract. The lessor may refuse this extension.

4. Cancellation of reservation

Any reservation will be canceled two hours after the scheduled rental time if the lessee does not notify of his delay.

5. Minimum age of policyholder

The lessee must be of legal age on the day of taking possession of the equipment.

6. Services and prices

The valid current rates are those published by the rental company, on its reservation platform and in its prospectuses for the current year.

7. Insurance

Insurance is the responsibility of the policyholder. By signing the rental contract, the lessee confirms that he has adequately covered the risks linked to the use of the rented equipment. The equipment is not insured by the rental company against theft and breakage within the framework of this contract. It is therefore up to the lessee to protect themselves from risks in the event of damage caused to the equipment.

8. Liability of the lessee

The lessee undertakes to use the rented equipment with caution, without danger to third parties. The lessee is always responsible for bodily injury and material damage that he causes when using the rented equipment (article 1242 of the civil code). LocaBeach Anglet cannot be held responsible in the event of damage caused or suffered by the lessee during the use of the rented equipment. In the event of damage due to an accident, loss, theft or improper treatment of the equipment, the lessee is responsible for the repair costs. In the event of total damage or loss, the lessee is responsible for the replacement value of the equipment, this invoiced in accordance with the rates in force and displayed in store.

9. Deposit

The lessor requires a deposit against loss, theft or damage to the equipment.

10. Applicable law

The contract and general rental conditions are exclusively governed by French law. Prior to any legal action, before the territorially competent court, the lessor and the seller undertake to resolve the dispute between them amicably, notably through a conciliation procedure.
